These terms and conditions shall govern the sale and purchase of products through our website. You will be asked to give your express agreement to these terms and conditions before you place an order on our website. This document does not affect any statutory rights you may have as a consumer (such as rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 or the Consumer Rights Act 2015).

Reproduction of our website is prohibited. Unauthorised use of our website may arise a claim for damages and/or may be a criminal offence. You may not create a link to this website from another website or document without our consent. Your use of our website and any dispute arising out of such use is subject to the laws of England and Wales.

INTERPRETATION

In these terms and conditions, "we" means Cakes By Lucy, "you" means our customer or prospective customer and "us", "our" and "your" should be interpreted accordingly.

ORDER PROCESS

The advertising of products on our website constitutes an "invitation to treat" rather than a contractual offer. No contract will come into force between you and us unless and until we accept your order in accordance with the procedure set out in this Section. To enter into a contract through our website to purchase products from us, the following steps must be taken - you must add the products you wish to purchase to your shopping basket then proceed to the checkout; if you are a new customer, you can create an account with us and log in or check out as a guest; if you are an existing customer, you must enter your login details; once you are logged in, you must select your preferred method of delivery and confirm your order and your consent to the terms of this document; you will then be transferred to our payment service provider's website, and our payment service provider will handle your payment; we will then send you an order confirmation (at which point your order will become a binding contract). If we are unable to complete your order, we will confirm that by email to apologise. You will have the opportunity to identify and correct input errors prior to making your order by emailing us on the email address listed on this website.

 

PRODUCTS

The following types of products are available to purchase on our website on select dates: ​

We will periodically change the specific products available on our website, and we do not undertake to continue to supply any particular product or type of product. The images of our products shown on our site are for illustrative purposes only, the product ordered and packaging may vary slightly.

 

PRICES

Some of our prices are quoted on our website; for full prices please contact us via the methods stated on our website. We will occasionally amend the prices shown on our website however this will not affect any contracts which are already confirmed. Alongside the price of the products shown, you will have to pay a delivery charge which will be notified to you throughout the checkout process before the contract of sale comes into force.

PAYMENTS

During the checkout process, you must pay the prices of the products you order for the sale to come into force by any of the permitted methods specified on our website. If you fail to pay any amount due to us under these terms and conditions, then we may withhold the products ordered and/or notify you that the sale has been cancelled.

If you make an unjustified debit card, credit card or other charge-back then you will be liable to pay us within 7 days of our written request. This amount will be equal to the charge-back plus all third party expenses incurred by us (including charges made by either our or your bank/card issuer/payment processor), an administrative fee of GBP 15.00 and all our reasonable costs and expenses incurred in recovering the amounts referred to in this section.

DELIVERIES

We will arrange for the products you purchase to be delivered to the delivery address you specify during the checkout process. We will use reasonable practices to deliver your products by the delivery date set out in the order confirmation; if no set date is provided you should receive your products within 10 days from your order confirmation. We cannot guarantee delivery by any date specified, this will be an estimate. All brownies and blondies will be posted out via Royal Mail 1st class the following day from your purchase. We are only able to deliver products to addresses on the UK mainland.

UPDATES

We may revise our terms and conditions occasionally by publishing a new version on our website. A revision of these terms and conditions will apply to contracts entered into at any time following the time of the revision, but will not affect contracts made before the time of the revision.

THIRD PARTY RIGHTS

A contract under these terms and conditions is for both our benefit and yours and is not intended to benefit or be enforceable by any third party.

AGREEMENT

These terms and conditions, together with our delivery policy and our returns policy, shall constitute the entire agreement between you and us in relation to the sale and purchase of our products and shall supersede all previous agreements between you and us in relation to the sale and purchase of our products.

STATUTORY AND REGULATORY DISCLOSURES

Our terms and conditions are available in English only. We will not keep a copy of these terms and conditions on record for each individual customer; whenever we update our terms and conditions the version available when you originally agreed will no longer be available therefore we recommend that you consider saving a copy for future reference.
